Labelcity Terms and Conditions

Welcome to labelcity.com.au. Labelcity is owned and operated by Label City Pty Ltd ("Labelcity").

These Terms & Conditions apply to all purchases made via our website www.labelcity.com.au (“the Site”). They must be read in conjunction with our Privacy Policy, Security Policy, Returns Policy, Shipping Policy, and Product Warranty.

These Terms and Conditions, together with the laws of New South Wales, Australia, apply to all transactions for the purchase of Labelcity products ("Products") through the Site.

These Terms and Conditions represent the entire Agreement between Labelcity and you (“the Buyer”). Placing Products in the shopping cart and completing the order form on the Site constitutes an offer to purchase (“Order”). Labelcity has the right to accept or reject the Buyer’s offer to purchase.

Prices

Prices for all Products will be those current on the date of purchase of the Order, less any applicable discounts. All prices exclude delivery fees, which are calculated at checkout.

Labelcity may change its prices without prior notice. All prices on the Site include Goods and Services Tax (GST). The GST payable and delivery charges will be shown as the Buyer completes checkout.

Email Address & Invoices

The Buyer must provide a valid email address to process an Order. It is the Buyer’s responsibility to ensure accuracy. Please check spam or junk mail folders for confirmations and invoices. A physical invoice will also be included with the shipment.

Stock Availability

If a Product becomes out of stock after an Order has been placed and payment has been received, Labelcity will notify the Buyer using available contact details to arrange revised delivery or refund options.

Orders

When purchasing Products the Buyer must select:

• The Product(s) to be purchased
• The quantity required

The Buyer must also provide:

• Delivery address
• Billing address
• Name of the person placing the Order

Orders will not be accepted if:

1. Payment is not made by an approved method (credit card, PayPal, etc.);
2. The payment provider does not confirm payment;

Once an Order is placed, Labelcity will send an email acknowledgement. If the Order is not accepted, the Buyer will be notified by email.

Order Modification or Cancellation

Labelcity requests that Buyers carefully check their Order and address details before submitting.

Orders are processed several times daily. To modify or cancel before shipment:

• Sydney Buyers: email Sales@labelcity.com.au before 10.30am or 3.30pm
• Other Australian Buyers: email before 2.30pm
• Buyers outside Australia: call +61 2 45 748 400 as soon as practicable

Orders cannot be modified or cancelled once shipped.

Delivery

• Orders within Australia are shipped by Australia Post, TNT, or Go-Logistics depending on the delivery address.
• Delivery is usually 1–2 business days (metro) or up to 7 business days (regional/rural).
• A signature may be required. If undeliverable, parcels will be redirected to the local post office.
• Orders may ship in multiple consignments; Buyers will be notified if this occurs.

The Buyer acknowledges that delays may occur, and Labelcity may allocate Products among customers at its discretion.

If an Order has not been delivered within two weeks, the Buyer should first contact Labelcity. In some cases, tracking may be checked on the courier’s website. In most cases, the parcel is awaiting collection at the local post office. If lost in transit, contact Sales@labelcity.com.au.

Payment

The Buyer may purchase Products by:

• Visa, MasterCard or American Express via eWay
• Visa, MasterCard or American Express or funds transfer via PayPal
• Direct Deposit

Credit card information will be verified by eWay or PayPal. The Buyer agrees to provide Labelcity, or the relevant credit card provider, with any information reasonably requested to authorise and verify purchases.

Labelcity does not process or retain credit card numbers or details. Additional security measures such as Verified by Visa, MasterCard SecureCode or American Express SafeKey may apply. Labelcity has no control over these systems. For issues with credit cards or BPAY, the Buyer must contact their bank or provider directly.

Labelcity reserves the right to exercise lawful remedies if a payment dispute arises. If a payment is rejected, Labelcity may delay or cancel delivery at its discretion.

Defective Products

A defective Product is one that suffers a “major problem” (as defined under Australian Consumer Law) within 30 days of operation. For online purchases, this period begins two days after delivery.

If the Buyer believes a Product is defective, they must contact Labelcity. If confirmed, Labelcity will issue a return label and instructions. The Product must be returned in its original packaging with all components, cables, and manuals.

Labelcity may cover return costs if the Buyer uses Labelcity’s nominated freight carrier. Once received, a replacement will be delivered at no cost.

Incorrect Supply of Order

If the Buyer receives the wrong Product due to a Labelcity error, they must notify Labelcity within 7 days. The incorrect Product must be returned unopened and in new condition. Labelcity will then ship the correct Product and arrange collection at no cost.

Products Damaged in Transit

If a Product is damaged in transit, the Buyer must notify Labelcity within 48 hours and mark the delivery note “Received Damaged.”

Delivery Outside Australia

Labelcity accepts international Orders but is not responsible for customs duties, landing taxes or GST payable upon delivery.

New Zealand and Polynesia Buyers (Samoa, Tonga, Cook Islands, Tuvalu, Tokelau, Niue, Wallis & Futuna, French Polynesia) should order via labelcity.co.nz. All other international Buyers must place Orders by phone on +61 2 45 748 400. Delivery charges will be confirmed at the time of order.

Amendment of Terms and Conditions

Labelcity may revise these Terms and Conditions at any time. Buyers are encouraged to revisit this page periodically for updates.

Labelcity Product Warranty

Non–Labelcity Product Warranty

Products not manufactured by Labelcity are covered by the relevant manufacturer’s warranty. Please refer to the manufacturer’s website for details.

Third Party Companies and Products

Mentions of third party companies, products, or websites are for information only and do not constitute endorsement. Labelcity is not responsible for their quality, safety, or suitability.

Links are provided for convenience only. Labelcity has no control over external content. By following such links, you leave the Site.

Buyer’s Use of the Site

The Buyer agrees not to:

1. Use the Site for unlawful or prohibited purposes
2. Copy, sell or exploit Site content without written consent
3. Collect or store personal information of other users
4. Attempt unauthorised access to any part of the Site, or upload viruses, worms, or malicious code
5. Fail to take precautions to protect their own computer system

Labelcity reserves the right to refuse service, cancel Orders, or terminate accounts if misuse is suspected.

Trade Marks and Copyright

The “Labelcity” trade mark is registered and owned by Labelcity, Inc. and authorised for use in Australia. Buyers must not do anything to place Labelcity’s trade marks at risk.

Unless otherwise stated, all text, images, audio, video, and materials on the Site are copyright Labelcity. Buyers must not reproduce, modify, or distribute without prior consent.

Site Security

Labelcity takes reasonable measures to maintain a secure Site but does not warrant that servers will be free from viruses or harmful components. Buyers must protect their devices against such risks.

Labelcity is not liable for:

1. Damage to computer equipment arising from Site use or downloads
2. Consequential damages from use or inability to use Site materials

Feedback and Information

Any feedback provided (by email or otherwise) will be considered non-confidential and non-proprietary. Labelcity may use such information without restriction.

Disclaimer

The Site is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Labelcity disclaims all warranties, including merchantability, fitness for purpose, and non-infringement. Labelcity does not warrant the accuracy or completeness of the information provided.

Limitation of Liability

Labelcity is not liable for damages arising from access to, use of, or inability to use the Site or its materials. Use of the Site is at the Buyer’s own risk.

Total liability for all damages will not exceed the amount paid by the Buyer, if any, for accessing the Site.

Jurisdictional Issues

Unless otherwise specified, information on the Site is intended for customers in Australia. Buyers outside Australia access the Site at their own risk and remain subject to Australian law.

Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.
